Judicial Foreclosure
In case of default judicial foreclosure process allows the lender to file a lawsuit and attain a court order to foreclose on a particular property. in accordance with the Delaware law lenders get a number of options in which they may pursue judicial foreclosure, however the most commonly used procedure is the Scire Facias (judicial writ).
In Delaware there is difference, nothing like judicial proceedings in other states which involves the lenders to prove that the borrower is in default of the mortgage. Judicial foreclosure In Delaware requires from the borrower to prove that they are not in default.
Generally the lender files a suit with the court to get an order for foreclosure and to prove that the borrower is in default. After filing suit by lender it is obligatory for the borrower to appear in court within twenty (20) days of being served with the judicial writ for the reason to provide proof that they are paying their payments at full and those foreclosure proceedings should not occur. Court can’t arrange the foreclosure sale unless the borrower provides proper avoidances not to foreclose. Foreclosure sale will be ordered by the court if the court is not satisfied with the borrower’s proof.
Arriving sale must be conducted by the sheriff at least fourteen (14) days after the notice of sale is posted on the property and in other public places all through the country .Said sale can be held either at the courthouse or at the property where ever it is located in a country. After the declaration of sale by court the buyer can’t avail any right of redemption.
